Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of Survyr, accessible at survyr.ai, operated by Constructive FZE, a Dubai Free Zone Establishment registered in the United Arab Emirates ("Constructive FZE", "we", "us", or "our").

By creating an account or otherwise accessing the Service you confirm that you have read, understood, and agreed to be bound by these Terms, together with our , , , and . If you do not agree with any part of these Terms, you must not use the Service.

2. Definitions

  • "Service" means the Survyr web application at survyr.ai and all associated features.
  • "User", "you" means any natural person who creates an account or otherwise uses the Service.
  • "Content" means any text, data, or materials that you create, upload, or generate using the Service, including diary entries, case study drafts, summary of experience text, CPD records, AI conversation history, mock interview transcripts, and presentation scripts.
  • "Platform Content" means all content provided by Survyr itself, including the question bank, model answers, hot topics, AI coaching responses, educational materials, and the design, code, and branding of the Service.
  • "Constructive FZE", "we", "us", "our" means Constructive FZE, the operator of Survyr.
  • "RICS" means the Royal Institution of Chartered Surveyors.

3. Account Registration and Eligibility

You must:

  • Be at least 18 years of age.
  • Provide accurate, current, and complete information during registration.
  • Maintain the security and confidentiality of your account credentials.
  • Use one account per person. Account sharing is not permitted.
  • Notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate any account we reasonably believe has been created or used in breach of these Terms.

4. The Service: What Survyr Is and Is Not

Survyr is an AI-powered coaching and preparation tool for candidates working towards the RICS Assessment of Professional Competence (APC), AssocRICS, and related RICS assessments.

Survyr is not:

  • A substitute for professional career advice, legal advice, or formal RICS guidance.
  • Endorsed by, affiliated with, approved by, or quality-assured by RICS in any way.
  • A tool for generating content to be submitted to RICS. The RICS Responsible Use of AI Standard (March 2026) prohibits candidates from passing generative AI output off as their own work in any assessed submission, and RICS uses AI detection on submitted material. Survyr is designed to coach, draft-prompt, and review your own work rather than to author submission content. You are responsible for ensuring your submissions are your own work and comply with the RICS standard in force on your assessment date.

Competency frameworks, route requirements, session dates, and assessment criteria shown in the Service are based on publicly available RICS documentation and are maintained on a best-effort basis. They may not reflect the most recent RICS changes. You should always verify requirements directly with RICS before relying on them for any submission or assessment.

5. Subscription Terms and Billing

Survyr offers:

  • Free: limited features at no cost. Available indefinitely with no payment required.
  • Pro: paid monthly or annual subscription at the prices shown on our Pricing page.
  • Assessment Ready: paid monthly or annual subscription at the prices shown on our Pricing page.

Payments are processed by Stripe. Survyr does not store payment card details. Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date. We may change prices with at least 30 days' notice to active subscribers; any change applies from the next renewal.

If you are a UK consumer, you have a 14-day right to cancel a paid subscription under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, beginning on the date of purchase. Refund handling and cancellation mechanics are covered in full in our .

6. Your Content: Ownership and Rights

You retain full ownership of all Content you create using Survyr. Your diary entries, case study drafts, summary of experience, CPD records, and any other material you produce remain yours.

You grant Constructive FZE a worldwide, non-exclusive, royalty-free licence to store, process, transmit, and display your Content solely for the purpose of providing the Service to you. This licence ends when you delete the Content or close your account.

We do not sell, share, or use your Content for any purpose other than delivering the Service to you. We do not use your Content to train AI models.

You can export your Content at any time using the Exports module. When you close your account your Content is permanently deleted within 30 days.

7. Platform Content: Our Intellectual Property

All Platform Content (including but not limited to the question bank, model answers, hot topics, AI coaching prompts and responses, educational materials, design, code, source prompts, logos, and branding) is owned by Constructive FZE and is protected by copyright, trade-mark, and other intellectual property laws.

You must not, without our prior written consent:

  • Copy, reproduce, distribute, scrape, or republish any Platform Content.
  • Use automated tools, bots, crawlers, or scrapers to extract Platform Content.
  • Reverse-engineer the Service or attempt to extract our AI system prompts.
  • Use the Service, or any component of it, to build a competing product.

The name "Survyr", the compass-star logo, and associated branding are trade marks of Constructive FZE (registration pending).

8. Acceptable Use

You must not:

  • Use the Service to generate content for submission to RICS.
  • Misrepresent AI-generated coaching output as your own work in any RICS submission.
  • Share your account credentials with any other person.
  • Attempt to circumvent subscription limits, feature gating, or rate limits.
  • Upload harmful, offensive, or illegal content.
  • Use the Service to harass, spam, or harm others.
  • Attempt to gain unauthorised access to the Service, to other users' accounts, or to our infrastructure.

9. AI Features: Specific Terms

AI coaching responses on Survyr are generated by third-party large language models (currently Anthropic Claude) and may contain inaccuracies, omissions, or out-of-date information. You should treat AI responses as coaching guidance and not as definitive professional advice.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. AI conversations may be analysed in anonymised, aggregated form to improve the Service.

The RICS Responsible Use of AI professional standard (effective 9 March 2026) applies to how you use AI in your professional practice as a member or candidate. Survyr's AI features are designed to comply with this standard when used as a coaching tool. For full detail see our .

10. Speech-to-Text and Voice Features

The mock interview and presentation rehearsal modules use third-party speech-recognition services (currently Deepgram) to provide real-time transcription. Your microphone audio is streamed for transcription and is not permanently stored by Survyr or Deepgram.

Voice features require microphone access, which you grant voluntarily through your browser. Transcription accuracy is best-effort and is not guaranteed. Background noise, accent, and audio quality can all affect the output.

11. Limitation of Liability

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

To the fullest extent permitted by law, Constructive FZE and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or assessment outcomes, arising out of or related to your use of, or inability to use, the Service.

Our aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the amount you have paid to us for the Service in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.

12. Data Protection

We process your personal data in accordance with our . We comply with the UK General Data Protection Regulation (UK GDPR), the UAE Federal Decree Law No. 45 of 2021 on the Protection of Personal Data, and the DIFC Data Protection Law No. 5 of 2020 to the extent each applies.

13. Termination

You may close your account at any time from Settings. We may suspend or terminate your account for material or repeated breach of these Terms, or where required by law.

On termination your access to the Service ceases and your Content is permanently deleted within 30 days. Sections relating to intellectual property, limitation of liability, data protection, governing law, and any provision that by its nature ought to survive, survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email to active subscribers at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with a material change, you may close your account before it takes effect and we will apply the refund rules in the Refund Policy.

15. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the courts of Dubai, UAE, save that we may bring proceedings for injunctive relief in any jurisdiction to protect our intellectual property.

For UK-based consumers, nothing in this clause affects your statutory consumer rights or your right to bring proceedings in the courts of your country of residence where UK or EU consumer law provides that right.
